SARAJEVO, May 9 (FENA) â€“ BiH Presidency Chair Haris Silajdzic proclaimed on Thursday Decision on Ratification of the Base Agreement between BiH and Serb Orthodox Church, adopted on Wednesday by other two members of BiH Presidency, as destructive for vital interest of Bih Federation.
Although he does not oppose a single part of the very text of the Agreement, and although he is of the opinion that the Agreement should be signed, Silajdzic did not support the Decision on Ratification because the document makes precise that it is based on an article of BiH Constitution which authorizes BiH Presidency for conclusion and ratification of the â€œinternational agreementsâ€, and on the Law on Procedure of Conclusion and Execution of the International Agreements.
Opinion of certain BiH officials that there is a difference between the so-called â€œinternationalâ€ and â€œinter-stateâ€ agreements is completely unfounded, as well as the claim that an individual or a private company can be a subject of the international agreements, Silajdzicâ€™s Cabinet announced.
International agreements, in that sense, cannot be made with Serb Orthodox Church for, unlike the Vatican, that church is not a sovereign state or an international organization, the announcement states.
Treatment of Serb Orthodox Church as a state or international organization would expose BiH to the procedures at the international court bodies if certain disagreements arise in the process of implementation of the agreement. It could also result in benefits for the church, which are exclusively reserved for states and international organizations, like immunity, etc.
Keeping in mind all the dangers, Decision on Ratification of the Agreement with Serb Orthodox Church, on the basis of wrong and impermissible Constitutional decrees is destructive for BiHâ€™s vital national interest, Silajdzicâ€™s Cabinet announced.
